This Public Offer (hereinafter referred to as the “Offer”) is an official and public proposal by the CHARITABLE ORGANIZATION
“BIRD OF VICTORY CHARITABLE FOUNDATION” (hereinafter referred to as the “Foundation”), represented by Anton Grygorovych Denysenko,
acting in accordance with its Charter, to enter into a Charitable Donation Agreement on the terms set forth in this
Offer, with any individual or legal entity that accepts such an offer (hereinafter referred to as
the “Donor”)

1. GENERAL PROVISIONS
1.1. This Offer constitutes a public contract in accordance with Articles 633 and 641 of the Civil Code of Ukraine and
is governed by the Law of Ukraine “On Charitable Activities and Charitable Organizations.”
1.2. Acceptance of this Offer is deemed to occur when the Donor makes a monetary transfer to the Fund
using the payment systems available on the Fund’s website https://birdofvictory.in.ua/ (hereinafter referred to as the “Website”),
or using the Fund’s bank account details.
1.3. Acceptance of the Offer means that the Donor fully agrees to all the terms of this Agreement, understands and
agrees with the purpose of the fundraising, and grants permission for the processing of their personal data.
2. SUBJECT MATTER OF THE AGREEMENT
2.1. The subject matter of this Agreement is the gratuitous, voluntary, and irrevocable transfer by the Donor to
the Foundation’s ownership of funds (a charitable donation) for the purpose of carrying out charitable activities in accordance
with the Foundation’s Charter and the laws of Ukraine.
2.2. The Donor independently determines the amount of the charitable donation.
2.3. Making a donation under this Agreement does not entitle the Donor to receive any commercial
benefit, material or other compensation from the Foundation.3. OBJECTIVES AND PROCEDURES FOR THE USE OF FUNDS
3.1. Charitable donations are allocated by the Foundation to achieve its statutory objectives and implement charitable programs/
projects, in particular to provide humanitarian, medical, and social assistance to service members of the Armed
, those affected by hostilities, internally displaced persons, and other categories of
individuals in need of assistance.
3.2. The Foundation has the right to use a portion of the funds received for administrative expenses related to
ensuring the Foundation’s operations, within the limits established by the current legislation of Ukraine (no more than 20%
of the Fund’s annual income).
3.3. If the amount of funds raised for a specific fundraiser or project exceeds the necessary amount or
if the implementation of the project has become impossible, the Fund reserves the right to reallocate the remaining funds
to other relevant charitable projects of the Fund.4. PAYMENT PROCEDURE AND REFUND POLICY
4.1. Charitable donations are made by the Donor in the national currency of Ukraine (hryvnia) or in
another currency (subject to subsequent conversion) via payment methods integrated into the Website, or by bank
transfer using IBAN details.
4.2. Refund Policy: In accordance with the Law of Ukraine “On Charitable Activities and Charitable
Organizations,” a charitable donation is irrevocable and non-refundable to the Donor, except
in cases provided for by the current legislation of Ukraine or upon proof of an
an erroneous transfer (e.g., a technical failure of the payment gateway) upon the Donor’s written request,
submitted within 14 days of the payment.
5. PROTECTION OF PERSONAL DATA
5.1. By accepting this Offer, the Donor consents to the Foundation’s collection, processing, organization, and
storage of their personal data in accordance with the Law of Ukraine “On the Protection of Personal Data.”
5.2. Personal data is used exclusively to fulfill the terms of this Agreement, to conduct
settlements, maintain records, and prepare the Foundation’s reports.
5.3. The Foundation undertakes not to disclose the Donor’s personal data to third parties, except in cases
provided for by the laws of Ukraine.6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The Foundation has the right to:
Receive charitable donations and use them in accordance with the terms of this Offer and the Bylaws.
Independently determine priorities and areas of use for funds within the scope of its statutory activities.
6.2. The Donor has the right to:
Receive information about the use of charitable donations through public reports posted on the
